The concept of circumstances aggravating administrative responsibility as well as theoretical and practical aspects of their application are considered in the article based on the analysis of regulatory legal acts and the positions of courts. The author formulates the definition of this legal category, substantiates the conclusion about the different legal nature of the circumstances aggravating administrative responsibility and qualifying elements of administrative offenses.
