The article considers the questions relating to the defense lawyer participating in the proving process in criminal cases. The author analyses scientific views on the defense lawyer conducting interrogations, making inquiries, obtaining references and other documents and on the ways of legalizing the evidential information collected by the defense lawyer. The author's wording of p.3 ch.86 of the Criminal Proceedings Code of the Russian Federation is presented.
