The article examines the genesis of the legal categories "crime" and "punishment". The positions of political and legal representatives of the ancient era are determined. In particular, the article examines the political and legal views of Aristotle and Plato of the legal categories "crime" and "punishment". An analysis of some domestic criminal norms containing provisions on crime and punishment is given. A comparative analysis of the legal aspects of ancient times and modernity is carried out.
