On the principle of incidentibility of the repeated participation of a judge in the consideration of the case

The article presents an analysis of Article 17 of the Civil Procedure Code of the Russian Federation, the position of the Constitutional Court of the Russian Federation is given. The author has discovered the problem of law enforcement of norms on the principle of inadmissibility of repeated participation of a judge in the consideration of a case. It is proposed to change the content and structure of Article 17 of the Civil Procedure Code of the Russian Federation, as well as to unify the norms of the Arbitration Procedure Code of the Russian Federation and the Code of Administrative Procedure of the Russian Federation in connection with the proposed changes, since the title of the article fixing the principle does not correspond to its content.
