About the contents of the legal certainty principle

Бесплатный доступ

In the article, the issues of the legal nature of the legal certainty principle are discussed, as well as the issues of its contents. It is reasoned that the legal certainty principle is a general principle of law and along with other legal maxims such as the rule of law principle, it forms the basis of all the national and international legal systems. The conclusions are made that despite the name of the principle, the contents of the legal certainty principle are most uncertain. Its provisions, repeatedly reproduced in the court practice of the ECHR, the RF Constitutional Court, the RF Supreme Arbitration Court, cannot be recognized as the exhaustive ones, because the ECHR, when following the evolutive principle of interpreting the European Convention for the Protection of Human Rights and Fundamental Freedoms of 1950, continues to discover new facets and meanings of this principle.
