On the content component of the principle of the language of criminal proceedings

The normative provisions of Article 18 of the Criminal Procedure Code of the Russian Federation (hereinafter referred to as the Code of Criminal Procedure of the Russian Federation) guarantee persons who do not speak the language of domestic criminal proceedings a number of rights related to the possibility of using their native language during criminal proceedings. Neglect of these legislative provisions will entail irreversible consequences associated with the violation of the vital activity of the entire mechanism of the criminal process. In this regard, there is a need for a detailed study of the content of the principle of the language of criminal proceedings from the position of its legislative regulation in the Criminal Procedure Code of the Russian Federation and the features of actual implementation. The author based on the analysis of criminal procedure legislation, theoretically structured the content of the principle of the language of criminal proceedings. It is proposed to include in its composition separate, legally established elements of criminal procedural activity that ensure the possibility of ensuring the right of participants in criminal proceedings to use their native language, including by involving professional translators in the criminal process.
