On the specifics of gaps in the penal enforcement legislation of the Russian Federation

The article substantiates the understanding of legal category of a gap in the law depending on the peculiarities of the area under consideration, the criteria and features of identifying gaps in the penal enforcement legislation are analyzed. The author provides reasons for differentiating between the gaps of penal enforcement legislation and other areas including "the criminal cycle", through the specific nature of the system, subject and method of legal regulation.
