A Criminal Object Against the Digital Security of the Healthcare System

The article substantiates the dual nature of the digital security of the healthcare system. It is proved that the digital security of the healthcare system, acting as a natural evolutionary stage in the development of information security in general and the information security of the healthcare system in particular, is organically integrated into the multilevel national security system of the Russian Federation, as well as that the digital security of the healthcare system is a natural evolutionary stage in the development of information security in general and the information security of the healthcare system in particular. The activity of the healthcare system is an independent object of criminal law protection. Creating a separate section or chapter of the Russian Criminal Code containing offenses against the digital security of the healthcare system seems impractical. The possibility of separating Chapter 28 of the Russian Criminal Code from Section IX “Crimes against Public Safety and Public Order” and establishing it as a separate section entitled “Crimes against Digital Security” has been demonstrated. In order to improve criminal legislation in the context of the global digital transformation of society, it is proposed to supplement part 1 of article 2 of the Criminal Code with a provision on ensuring digital security as one of the independent tasks of criminal legislation.
