Ensuring access to justice for the suspect/accused by providing a real opportunity to collect evidence

The article is devoted to the analysis of individual actions of the suspect/accused and his defense counsel aimed at obtaining evidence. A survey by a lawyer of a person with his consent is considered as a way of obtaining information for inclusion as evidence. On the basis of the studied positions of scientists and practitioners, specific proposals were made aimed at expanding access to justice for the suspect/accused and his defense counsel, as well as the victim and his representative within the framework of the preliminary investigation stage, expressed in the real possibility of obtaining evidence by imposing certain duties on the investigator.
