The article analyzes the problems associated with the definition of common property in residential complexes. The author focuses on the issues arising in connection with the lack of direct legal regulation of relations regarding the property created by developers at the expense of participants in the shared construction of several apartment buildings and intended for the maintenance of these houses. Concludes that it is necessary to amend legislation in order to exclude grounds for litigation over such property and formulates specific legislative initiatives.
