Protection of public order and ensuring public safety as a subject of administrative and legal regulation of the powers of the troops of the National Guard of the Russian Federation

The protection of public order, that is, the maintenance of the existing socio-political organization of Russian society, is ensured by many factors of state development, including the presence of National Guard troops, which by the very fact of their presence ensure the implementation of preventive managerial functions, for example, motivational, that is, stimulating lawful behavior. The displacement of abnormal variants of the development of public relations within the framework of the established administrative and legal regimes for the protection of public order and ensuring public safety is carried out by employees and servicemen of the National Guard troops on the basis of legality, respect for human rights and freedoms. From the point of view of the methodology of administrative law, we propose to consider the licensing activities of the Federal Service of the National Guard Troops in the field of arms control as a means of transforming the administrative-imperative (imperative) method of legal regulation into administrative-permissive (permissive). In the course of the study, the author came to the conclusion that the competence of the National Guard troops in terms of administrative and supervisory powers can be considered as an effective means of controlling the influence of public authorities on relations related to the functioning of critically important private objects of civil turnover.
