Determining and ensuring the order of communication of a child with a parent living separately

This article examines the issue of ensuring the procedure for communication with aminor child of a parent living separately, methods and options for protecting this right, and providesrecommendations on protecting the right to communicate with the child in court. The grounds andrequirements for a statement of claim to establish the procedure for communication with a minorchild are described. The necessary evidence base that a parent living separately must provide tothe court to support his or her position is also considered, and the distribution of the burden ofproof in this trial is described. In addition, this article examines the issue of bringing the secondparent to justice for violating a court decision on the procedure for communication with the childof the second parent, measures of influence on the second parent through bailiffs, provides theregulatory framework and experience of law enforcement practice, including our own.
