The article analyzes approaches developed by judicial practice to determining compensation for unfulfilled major repairs of an apartment building when calculating the redemption price of residential premises when seizing a land plot for state or municipal needs. The author concludes that the right to receive such compensation is not directly enshrined in law, and is determined only by established judicial practice. He makes proposals to improve legislation and the practice of its application.
