Optimization of means for achieving a balance of interests of the parties in criminal proceedings

The author substantiates in the article the conclusion that the infliction of criminal proceedings, enshrined in the criminal procedure law, needs to be reviewed. Through the prism of restorative justice, the procedural means for achieving the infliction of criminal proceedings and the balance of interests of the parties in pre-trial and court proceedings are analyzed; a conviction without sentencing is considered as one of such means.
