Organizational and legal approaches to the allocation of types of tourism for the purpose of satisfying public needs

Tourist services are a significant part of socio-cultural services, which in recent years have received considerable attention from the Government of the Russian Federation. Legal aspects are the basis for the organization and functioning of tourism activities. They also form the basis of the subsystem of management and regulation of the Territorial Recreational System. However, they are still insufficiently studied. This is largely due to the fact that the specifics of the tourism sector require, on the one hand, a public law approach, on the other hand, it relies on civil law foundations, primarily from the standpoint of business law. At the same time, in tourism, these two areas are very closely intertwined, since the creation of conditions for entrepreneurial activity in the field of tourism and entrepreneurial activity itself are interdependent. For instance, varieties in the definition of the same type of tourism in different regulatory documents can create discrepancies in the implementation of competitive procedures aimed at stimulating tourism activities. The authors in their study relied primarily on the organizational and legal approach, which is aimed at identifying opportunities to ensure the development of the tourism sector through the development and implementation of targeted impacts in the field of management from the standpoint of economics and law. The results are presented in the form of recommendations for improving the organizational and legal mechanisms for the development of tourism in Russia. The author's approach to legislative activity in relation to the types of tourism is proposed.
