Grounds and conditions for change of crime category by the court

Currently, a new round of development of crime has appeared (part 6 of article 15 of the Criminal Code of the Russian Federation). The work is devoted to the study of what to provide such concepts as the grounds and conditions for changing the category by the court. The paper points out the identity of the concept of factual circumstances (Resolution of the Plenum of the Supreme Court of the Russian Federation of 05/15/2018 №10 "On the practice of application by courts of the provisions of part 6 of Article 15 of the Criminal Code of the Russian Federation") to the concept of specific circumstances (Resolution of the Plenum of the Supreme Court of the Russian Federation of 22.12.2015 №58 "On the practice of the courts of the Russian Federation of criminal punishment").
