Grounds for obtaining samples for comparative research as an investigative action

The article is devoted to the urgent problem of obtaining samples for comparative examination in the framework of criminal proceedings in Russia and is an in-depth analysis of existing approaches to this procedural activity. The author reveals that today there is no consensus in the scientific community about the legal status of the sample collection process, which reflects shortcomings both in the legislative framework and in the practical application of these norms. The author states that the multifaceted interpretations of the process of obtaining samples not only causes legal uncertainty, but also complicates further procedural analysis. The evidence base of the article consists of arguments presented by leading scientists and practitioners who demonstrate a variety of points of view on the problem. The author includes the need to harmonize legislation with modern requirements of the criminal process, emphasizing the importance of legal guarantees for participants in the process and the need to standardize approaches to obtaining samples. Attention is also focused on the impact of scientific research on the formation of law enforcement practice.
