An article with this title was previously published by the author almost a quarter of years ago - in 1996 [1], that is, in the midst of those "90s" that have become common nouns. However, the content of this work seems to be relevant for modern Russia as well. It should also be taken into account that at that time the article was published in a ministerial collection of conference materials in a meager print run, and, of course, it did not get into any electronic catalogs. Meanwhile, modern publishing technologies make it possible to get acquainted with the author's reasoning to a much wider circle of interested readers. In addition, the reprint of the article will be of interest from the point of view of the development of criminal law in Russia. In the article, the author examines the problem of the legal status of persons serving life imprisonment, substantiates proposals for the then discussed draft of the criminal and penal codes.
