The article reveals the features of legal guarantee in public and private law. The study identifies the similarities and differences in the system of legal guarantee applied in private and public law areas. The research describes the subjects of legal guarantee and the mechanisms of its implementation. The main differences in legal guarantee in public and private law can be explained by the persistent divergence of public and private interests. Special attention is paid to the issues of a more effective legal regulation in the above-mentioned areas of law in the modern context. The author proves that it is necessary to apply different approaches to improve legal guarantee mechanisms within the system of private and public law.
