Features of the Licensor's Obligation to Grant the Right to Use Intellectual Property When Concluding a License Agreement on the Internet

This paper examines the specifics of confirming a licensor's fulfillment of its obligation to grant the right to use intellectual property under online licensing agreements. The author analyzes established approaches to fulfilling this obligation, as developed in academia and legal practice. The paper substantiates the need for a higher standard of proof for licensors to demonstrate both the fulfillment of their obligation to grant the right to use intellectual property and their actual ability to exercise the rights granted to them.
