Features of the division of common property of spouses

The article discusses some issues of the division of the common property of spouses, on which there is no uniformity in judicial practice: departure from equality of shares, payment of compensation if it is impossible to allocate a share in kind, as well as issues related to the confiscation of the common property of spouses and the determination of the shares of each of them. As a result of the study, conclusions are made about the specifics of the legal regulation of these issues due to the diversity of individual situations and necessity of theoretically developed guidelines are needed in the explanations of the Supreme Court of the Russian Federation based on the grounds offered by judicial practice.
