The article examines the features of understanding and comparing the relationship between social responsibility and legal liability in light of the purpose of a legal obligation. The central attention in the article is paid to the concepts of the founder and main theorist of the concept of the social state, L. von Stein. The following features of the social state are highlighted: its obligatory nature, understanding of social responsibility in the context of social partnership, and others. Attention is drawn to the understanding of the issue by another leading constitutionalist of our time, B.S. Ebzeev. The scientist sees the static and dynamic side of the Constitution. It is concluded that it is the legal obligation and its doctrinal justification that should be recognized as a universal means and method of normative and legal regulation of social relations, since obligations exist in all types of legal relations, and their proper fulfillment determines whether the state will be legal and constitutional or not.
