Special proceedings in civil procedural legislation: the problem of normative definition

This article discusses the features of the legal and theoretical aspects of the normative definition of special proceedings in civil procedural legislation. The scientific literature on a given problem is being studied, as well as practical domestic experience. It seems appropriate at the level of federal legislation to formulate the concept of special proceedings as a specific type of civil proceedings in a court of first instance, not of a controversial nature, and aimed at certifying the existence of certain legal facts, the legal status of persons, things or resolving the issue of committing certain legal actions, which is the basis for the implementation of the subjective rights of applicants in substantive legal relations.
