Supporting state prosecution in a criminal trial as an element of prosecutor's authority in Germany and Russia

The article presents the main characteristics related to the procedural status of the prosecutor who exercises prosecutor's power in the court while supporting public prosecution in Germany and Russia. As positive peculiarities the author highlights conducting a preliminary investigation in Germany under the prosecutor's supervision, drafting an indictment by him/her and supporting charges on it in the court, with the most active role of the court establishing the truth in the case. Proposals addressing to the Russian legislator to implement this experience into the Russian criminal procedure are made.
