The article provides a comparative theoretical and legal analysis of the dialectical formation of the «concept» of society in the political and legal views of Lorenz von Stein on the basis of the doctrine of Hegel's subjective logic and the application of dialectical aws of development. A consistent study of the main stages of the development of society is due to the formulation and resolution of a social issue, the essence of which is to establish the relationship and interdependence of a person, personality, citizen, society, state and law. In this regard, the study of the essence and content of the formation of the category of society allows us to answer the social question, to define the purpose of a person in society and the state, to study the genesis of the formation and formation of the concepts of the social state and civil society, which is, of course, relevant for the modern process of their formation in Russian Federation. At the same time, the study of the dualistic nature of society, which, on the one hand, determines the purpose of a person, and on the other hand, includes one's own self-determination, independent will and action, is of certain interest within the framework of the above-mentioned topics of the scientific article. Moreover, with regard to the dualistic content of the «concept» of society, the article draws a significant conclusion about the common principles of the formation of society and the state at the stage of «community», which, in essence, determines the liberal approach in the state legal doctrine and substantiates the need for the formation of a social legal state and civil society, the highest purpose of which is the all-round development of the individual.
