The consequences of a delay in lease payments when purchasing public land

Frequent refusals of administrative bodies to provide the tenants with the ownership rights to land plots determine the relevance of the study. A primary analysis of the reasons for such refusals draws attention to the lack of the unified doctrinal approaches and the case law in this regard. This situation generates legal uncertainty and often leads to a violation of the rights of land tenants. The research analyzes the legal provisions on land distribution in the context of the legal consequences of a delay in lease payments. It is concluded that a delay in lease payment cannot be regarded as a misuse of land. The author assumes that a breach of the lease agreement relating to payments is not the basis for a refusal to purchase the land by the tenant.
