Mediation in Bribery: Concept, Problems and Prevention

Introduction. At the present stage issues related not only to the definition of the concept of “mediation in bribery” but also to the effectiveness of prevention of this phenomenon are being updated. The goal is to identify common approaches to the definition of the concept of “mediation in bribery” and to propose effective measures to prevent this illegal act. Materials and Methods. The researchers employed general scientific methods of cognition, such as the dialectical method, methods of deduction, induction, synthesis and analysis. Along with general scientific methods, special research methods were used: formal-legal, comparative-legal. The criminal legislation of Russia, theoretical concepts and the development of scientific literature in the field of criminal law constitute the methodological basis for the formulation of the main provisions of the study. Results and Discussion. The analysis of scientific approaches to the definition of the concept of “mediation in bribery”is carried out. The authors’ scientific definition of the concept of “mediation in bribery” is proposed, its main features are specified: the interest of the intermediary, the amount of the bribe, the direct transfer of the bribe, the subject of the bribe. Special attention is paid to the legal conflicts of mediation in bribery and the analysis of the most effective measures for its prevention. Conclusions. “Mediation in bribery” is performing appropriate intermediary functions on behalf of the bribe recipient or the bribe giver, which are aimed at achieving a specific goal or another agreement between them. The most effective measures to prevent mediation in bribery are the formation of an ideology of law-abiding behavior in society and creation of an atmosphere of intolerance to corruption.
