Rules of the Constitutional Court of the Republic of Azerbaijan in the field of criminal regulation

Interpretative practice of the Constitutional Court in the field of criminal law is considered in the article. As a result of the analysis of a number of the last judgments devoted to interpretation of criminal law precepts it is summarized that acts of this Court play a special role in the mechanism of legal regulation, because they directly determine the content of these norms and order of their application according to the Constitution. We consider such concepts as «judicial precedent» and «legal position of the Constitutional Court of the Republic of Azerbayjan» and arrive to a conclusion that they are not identical.
