The right to safe labor conditions in the Republic of Kazakhstan: improvement of the economic and legal mechanism

The article analyzes the implementation of the constitutional right of citizens to safe working conditions, labor legislation and by-laws on the certification of production facilities and the assessment of occupational risks. Attention is focused on legal conflicts related de jure to the certification of industrial production facilities, which is de facto interpreted more broadly and includes the certification of workplaces and other segments of the economy. In addition, a conflict has been identified at the interdepartmental level (the Ministry of Labor and Social Protection of the Population of the Republic of Kazakhstan and the Ministry of Energy of the Republic of Kazakhstan) related to differences in approaches to homogeneous public relations to ensure safe working conditions. The author refers to doctrinal views on the global problems of organizing and improving the labor protection management system (LPMS), taking into account the industry specifics of organizations, enterprises, and institutions. It is stated that, depending on the specifics and dynamics of the development of the sector of the economy, there are similar and distinctive features, a range of problematic issues, obstacles to the formation of a full-fledged system of budgeting expenses for LPMS costs. Based on a constructive and critical analysis of the situation, it was concluded that the current LPMS system should be proactive, human-centered and needs to be further improved in terms of forming a cost budgeting mechanism as a key financial instrument that allows achieving social and economic effect on the one hand and meeting international standards , which is also aimed at by the Concept of the legal policy of the Republic of Kazakhstan until 2030 and the Concept of Safe Labor in the Republic of Kazakhstan until 2030.
