The right of development: historical analysis of the development of the roman model of the institute of superficies

This article analyzes the historical aspect of the development of the hereditary right of development, namely, the formation of a superficiality in ancient Rome is considered: from the obligatory lease relationship between the landowner and the developer to the most developed structure of limited property law. The economic and political prerequisites for the development of these legal relations are formulated. The specifics of concluding an agreement on the construction of someone else's land plot are determined, as well as ways to protect the subject of the right of inheritance of the right of development.
