Law enforcement of general and special grounds for recognizing a transaction as invalid in the framework of banknote

This article examines the ratio of general civil and special rules specified in the Federal Law "On Insolvency (Bankruptcy)", their application in the recognition of a debtor's transaction with abuse of law invalid within the framework of a bankruptcy case. The problem of identifying the limits of the disposition of Article 61.2 of this Federal Law for the enforcement of special and general civil norms is raised. Based on the analysis of judicial practice, an attempt is made to identify defects that go beyond the scope of a suspicious transaction and to assess their application in bankruptcy cases.
