Legal description of the mortgage agreement

The author of this article examines the legal characteristics of the mortgage agreement and, accordingly, its legal regulation. The concept of a mortgage agreement, its subject matter and essential conditions are revealed. The general norms of civil law governing legal relations under a mortgage agreement are given. The features of the mortgage of an apartment in an apartment building, parts of which, on the basis of civil legislation, are in the common shared ownership of the mortgagor and other persons are noted. The issue of the procedure for the division of spouses' property in the presence of a mortgage agreement is discussed.
