The legal nature of digital goods in modern economic realities

The article is devoted to the assessment of the essential characteristics of a digital product. Attention is drawn to the fact that there is no consensus in the legal doctrine on the legal nature of a digital product. It is clarified that some difficulties in the legal qualification of digital goods are also related to the peculiarities of its civil turnover, in particular, the transformation of the classical concept of “property”, the platformization of civil legal relations, contractual digital interaction, in addition, the turnover itself occurs in addition to specific borders of states (for example, software distribution occurs outside customs and tax control). The correlation of the studied category and the “product” in the classical sense, as well as with the concept of “service”, is carried out. The identified specific features of a digital product predetermine its own legal regime. It is concluded that in relation to digital goods, there is a need to create special rules.
