Legal nature of the Russian criminal procedure

The article is devoted to the study of the problem of the legal nature of the Russian criminal procedure. The Code of Criminal Procedure of the RF is eclectic, formed under the influence of the Soviet, continental and some elements of the Anglo-Saxon types (models) of criminal procedure. The reforms that took place after the adoption of the Code of the Criminal Procedure of the RF in the modern Russian criminal procedure indicate a search for a vector of its development. As a result of the analysis of the main types (models) of criminal procedure and taking into account the history of origin and formation of the process in Russia, the system of stages and institutional foundations, the author came to the conclusion that despite the eclecticism of the modern Russian criminal procedure, which constitutes its specificity, the Russian criminal procedure belongs to the continental (Romano-Germanic) type (model) of criminal procedure and has much in common with the German criminal procedure.
