Legal regulation of cottage estates

The rules of the Federal Law No. 476-FZ of December 30, 2021 and the Resolution of the Constitutional Court of the Russian Federation No. 55-P of December 28, 2021 have been analyzed. In particular, before these documents, cottage’ owners sometimes shied away from paying infrastructure fees. The Federal Law No. 476-FZ of December 30, 2021 contains a new basis for the emergence of common shared ownership of the common property of a cottage estate. This rule should solve most of the problems that arise in judicial practice, as it seems. For instance, if the owners refuse to pay the costs of maintaining the intra-settlement infrastructure. It is concluded that the new law lacks rules on the entry of owners into condominiums, as well as rules that prevent abuse by developers when they clearly overestimate the cost of common property.
