Legal status of a large family as an object of constitutional-legal protection

Family, motherhood and childhood are under the protection of the state. The important role of the family in the development of the state is emphasized by the Decree of the President of the Russian Federation No. 63 “On measures of social support for large families”, which became effective on January 23, 2024. The mentioned act fixed a number of novelties in the legal regulation of a large family, which significantly change the status of a large family and need to be analyzed. In particular, for the first time at the federal level the definition of a large family is fixed, it is determined that a certificate confirming the status of a large family of a single sample and the maintenance of a data bank on large families will operate throughout the Russian Federation. The paper substantiates the constitutional and legal significance of the norms of Presidential Decree No. 63 “On Measures of Social Support for Large Families”. The analysis of the definition of a large family enshrined in the current legislation has allowed us to identify a system of interrelated principles that characterize its legal status as an object of constitutional and legal protection. In particular, the principles of indefinite duration, autonomy, independence from social support measures. Particular attention is paid to the possibility of practical realization of these principles at present both at the federal and regional levels. Some legal gaps hindering the realization of the mentioned principles are revealed and ways of their solution are offered.
