Legal basis for providing staff housing to military personnel of the national guard of the Russian Federation

Introduction: the authors investigate legal bases for legal regulation of the procedure for providing staff housing to military personnel of the National Guard of the Russian Federation. The legal regulation of determining the standard area of the staff housing is also considered. The correlation of general and legal norms of federal legislation and by-laws is analyzed. Materials and Methods: a comprehensive methodology of theoretical, logical, empirical methods was used to fully investigate the subject. Results: the authors concluded that a special procedure for providing staff housing was applied and functions to military personnel of the National Guard of the Russian Federation. The authors believed that theoretical possibility of usage of the disposition principle including departmental regulatory laws and regulations to the issue of mandatory recognition by the Federal law of Russia No 76 "Status of Servicemen Act" dated 27/05/1998 the order of material support of the military personnel and their families, namely space allowance determination of staff housing is unacceptable. The authors stated that it was necessary to legally exclude corporate housing to members of the armed forces of less area according to the Status of Servicemen Act. Academic arguments to the approach and arguments on legality of the standard of space allowance of corporate housing in the municipalities were in the study. Discussion and Conclusions: the authors come to the conclusion that special norms of federal legislation that establish, among other things, socio-economic guarantees of rights of military personnel as a result of academic analysis are of priority importance for the subject of legal regulation under study. The analysis is not exhaustive, but suggests further study in the chosen direction; the content of the study and the results obtained can be used in the subsequent analysis of the legal basis for the procedure for providing staff housing to military personnel of the National Guard of the Russian Federation and military personnel.
