The article examines the specifics of the subject of evidence in cases of recovery of compensation for improper conditions of serving a sentence in accordance with the procedure provided for by the Code of Administrative Procedure of the Russian Federation. Attention is focused on the expansion of the subject of evidence in this category of cases in law enforcement practice, which negatively affects the protection of the rights of persons serving sentences and claiming to receive designated compensation.
