The subject of smuggling set forth in Article 229.1 of the Criminal Code of the Russian Federation and the prospects of its legislative regulation

The research deals with the subject of smuggling stipulated by Article 229.1 of the Criminal Code of the Russian Federation. The study emphasizes the validity of a special criminalization of its kind based on the properties of the appropriate means, substances, plants, and equipment and carried out in accordance with the international legal acts and provisions of national legislation. Besides, the author points to the vulnerability of the legislator who referred smuggling of potent and poisonous substances to crimes against public security and included these substances in the terms of objects of the above-mentioned encroachment set forth in Article 226.1 of the Criminal Code. The study proposes amendments concerning the subject of smuggling to Article 229.1 of the Criminal Code of the Russian Federation by including information about potent and poisonous substances in it. At the same time, the obstacles for such solution and the ways to overcome them are noted.
