The Subject of Legal Regulation and Its Relation to Similar Concepts

Introduction: despite the fact that the concept of “the subject of legal regulation” has been used in legal science for quite a long time, there is no monistic interpretation of it in the general theory of law, which makes it difficult to understand and apply this term; therefore, it requires certain theoretical explanations. The emergence of new technologies for evaluating normative legal acts allows the theory of law to enter a new stage of its development and theoretical understanding, revising the established scientific concepts. Purpose: based on the analysis of general theoretical works, to propose the author’s concept of the subject of legal regulation. Methods: the research methodology is based on the general philosophical research techniques (deduction and induction, analysis, generalization). The special legal research method, the historical-legal method, and the method of deducing concepts are also used. Results: as a result of the conducted research, the main approaches to understanding the subject of legal regulation are described, its features and correlations with such similar concepts as legal regulation, the scope of legal regulation, the limits of the scope of legal regulation and the subject of legal impact are revealed. Conclusion: it is concluded that the subject of legal regulation is a constantly updated range of the most important relations in society, which by their nature can, and as confirmed by the results of legal monitoring, are amenable, or in the future need legal regulation using a system of instrumental legal means.
