Application of standards of proof in courts of general jurisdiction

The present study substantiates the necessity of formulating the standards of proof and their confirmation in courts of general jurisdiction of the Russian Federation. There is given a brief overview of development and use of the term “standard of proof” in Russia. The authors analyze various interpretations of the given term in the theory of law. The authors examined the types of standards of proof which exist these days in the Russian legal system, considered them in the framework of litigation practice and revealed certain problems on the part of absence of a uniform use of the term under consideration. A large number of relevant cases of the courts of general jurisdiction, as well as the established practice of the Judicial Chamber of the Supreme Court of the Russian Federation for Economic Disputes served the material of the present study. The research reflects the topical issues of legal precedents with respect to application of standards of proof in the courts of general jurisdiction and it can be useful for practicing lawyers.
