The principle of immediacy in the court of appeal in criminal proceedings

The article deals with the question of the operation of the principle of immediacy in the court of appeal. The purpose of the study is to identify the features of the principle of immediacy in the judicial proceedings of the court of appeal, taking into account the goals and objectives of this stage of criminal proceedings. Based on the analysis of the doctrinal understanding of the principle of immediacy of judicial proceedings, as well as the goals and objectives of the appellate review of criminal cases, the author comes to the conclusion that the principle of immediacy, being a procedural method of obtaining evidence in a criminal case, operates in the court of appeal truncated, without distorting the principle of adversarial and ensuring effective judicial proceedings in a higher instance.
