Acquisition of ownership under a contract

The issues regarding the moment of transfer of ownership are describes in this article; the existence of legal succession and the dependence of the subjective rights of the new owner on the subjective rights of the previous owner are argued; substantiates the expediency of fixing in the Civil Code of the Russian Federation a provision on a legal fact fixing the transfer of real estate within the framework of a consensual real estate donation agreement; it is proposed to recognize the need to go to court to recognize the ownership of real estate arising from acquisitive prescription.
