Privileged signs of murder by a mother of a newborn child, affecting the degree of its social danger, as a basis for differentiation of criminal liability

The article examines the signs that allow us to consider the murder of a newborn child by a mother as a privileged type of intentionally causing the death of another person. Among them, the author includes a set of special (excusable) signs of the subjective and objective aspects of the crime. It is the combination of these characteristics that makes it possible to take into account the actual degree of social danger of a crime and to reasonably reduce criminal liability without violating the principle of justice.
