The problem of legal regulation of public-territorial relations: a structural change is necessary

In accordance with the Constitution of Russia, the following types of public-territorial organizations are provided for in our country: the state as a whole, subjects of the Federation, municipalities. At the same time, each type of public-territorial entity has its own status, which is determined by the norms of the Constitution of Russia and the relevant federal and regional laws and municipal-legal acts. The article considers the problem of legal regulation of this status, which lies in the lack of systematic regulation of this kind of public relations. Thus, in relation to municipalities, there is the Federal Law "On General Principles of Organization of Local Self-Government in the Russian Federation", but in relation to the subjects of the Federation there is no similar federal law, as a result of which the potential of federal relations is not used to a sufficient extent. It should also be borne in mind that public-territorial relations are constantly developing, and new normative legal acts are appearing in this area. In this regard, the need for a structural change in the subject of regulation of public-territorial relations is substantiated, namely, it is proposed to single out public-territorial law as an additional element to the currently generally accepted system in the form of a well-known triad ("legal norm-institution of law-branch of law"), which can be designated as the "integral of law", that is, in this case, the integral of public-territorial law, where it is advisable to include branches of law related to this subject.
