Problem aspects of bounding the necessary defense and the extreme necessity

The article discusses the criteria for distinguishing between necessary defense and emergency as circumstances precluding the crime of an act. On the basis of the analysis of legislative constructions and the points of view available in the science of criminal law, a system of criteria has been proposed to distinguish between necessary defense and emergency. It is concluded that, despite the presence of many similar points, there are significant differences between the necessary defense and emergency.
