Problems of qualification under article 297 of the Criminal Code

In this scientific work, the problems of qualification of crimes provided for in Article 297 of the Criminal Code are considered. The relevance of the study lies in the problems of judicial proceedings in distinguishing the elements of crimes according to similar compositions, namely Article 5.61 of the Administrative Code of the Russian Federation and Article 319 of the Criminal Code of the Russian Federation. As part of our study of this issue, we raised the question of the possibility of amending the current legislation in order to more accurately determine the corpus delicti. As a result, it was revealed: firstly, the lack of a legislative interpretation of the insult in Article 297 of the Criminal Code of the Russian Federation; secondly, options for changing the current legislation were proposed.
