Problems of legal regulation of equipment supply

Бесплатный доступ

The supply of equipment has specifics, consisting in the need for the supplier to perform actions not only to transfer the goods to the buyer within the agreed period, but also to install, commission and perform other elements of technological maintenance of the equipment prior to its commissioning. These legal relations cannot be regulated solely by a contract for the supply of goods, in which the supplier is only obliged to transfer the equipment to the buyer, but the structure of the mixed contract does not fully meet the specifics of these relations. In this case, the liability of the supplier, who failed to ensure the installation of the equipment after its delivery, is limited to the cost of the work; in case of transfer of equipment with defects, the supplier is only responsible for the replacement of the goods, and not for violation of the installation deadlines. The most reasonable would be to understand the contract for the supply of equipment as a single obligation in which the supplier is responsible for the final result.
