Problems of legal regulation of tenders within the framework of the contract system and possible directions for their solution

The article is devoted to the legal regulation of procurement for state needs carried out under the contract system. The interconnection of the economic content of contract procurement mechanisms with their legal regulation is shown. It is noted that it is legal norms that contribute to the creation of conditions close to market competition during bidding, which ensures the effectiveness of procurement. Among the problems related to the legal regulation of tenders, the uncertainty of the consequences of the proposal to deliver the service for free when it does not contradict its economic content is noted. The problem of the possibility of using offers on the websites of suppliers that do not have the status of a public offer as the initial price of the contract is highlighted. Methods for resolving these contradictions are proposed.
