Problems of legal proceedings arising from the implementation of the administrative supervision of persons released from places of detention

The article discusses the problems encountered by courts in the process of applying the rule of law governing legal relations in the field of administrative supervision of persons released from places of detention. To achieve this goal, the authors analyze the data of judicial statistics, prosecutors, internal affairs bodies on the basis of which they draw conclusions about the development of recidivism emerging in recent years. Based on a study of judicial practice materials and discussions conducted in expert circles, the authors identify a number of problems that courts of general jurisdiction face while considering issues related to resolving cases of establishing, changing and removing administrative supervision. According to the results of the problem analysis, the authors propose measures aimed at improving the legislative and enforcement aspects of the courts.
